These Terms & Conditions (“Terms”) apply to https://bloomandbarrelwine.com (the “Site”). The Site is operated by The Feral Cat Co., dba Bloom & Barrel (“Feral Cat,” “we,” “us,” or “our”). By using the Site or any related services (the “Services”), you agree to these Terms and our Privacy Policy at https://bloomandbarrelwine.com/privacy-policy/.

If you disagree, do not use the Site or Services. If you are using the Site on behalf of a company or organization, you represent that you are authorized to accept these Terms on its behalf.

Please read carefully. These Terms include an agreement to arbitrate, a class action waiver, and other important information about your legal rights.

1) Important Disclaimers

Hemp-derived products. Products offered on this Site are hemp-derived cannabinoid beverages that are intended to comply with federal limits of less than 0.3% delta-9 THC on a dry weight basis. Products are not evaluated or approved by the FDA and are not intended to diagnose, treat, cure, or prevent any disease.

Know your laws. You are responsible for understanding and complying with the laws in your state and local jurisdiction related to purchase, possession, and use of our products. Your use of the Site and Services must be lawful.

Geography. The Site is controlled from California. We do not represent that the Site or products are available or appropriate in every location. We may limit availability by state or zip code and may refuse or cancel orders that do not meet our shipping eligibility.

The disclaimers above supplement the warranty and liability sections below.

2) Eligibility and Accounts

Age 21+. You must be 21 years of age or older to access or use the Site or Services. If you are under 21, do not use the Site.

Registration. Some features may require you to create an account or provide information. You agree to provide accurate, current information and keep it updated. Your account credentials are your responsibility. Notify us right away of any unauthorized use.

Service changes. We may change, suspend, or discontinue any portion of the Site or Services at any time without liability.

Use and storage. We may set general practices and limits for use and storage and may delete data or content as permitted by law.

3) Age Verification Policy

Bloom & Barrel is committed to responsible commerce and complies with all applicable laws governing age-restricted products. Our beverages are intended only for adults aged 21 and over. To protect consumers and prevent unlawful sales, we maintain strict age-verification procedures for all purchases made through the Site or retail partners.

3.1 Legal Compliance

We verify age in accordance with federal, state, and local laws. We may verify a customer’s identity or age before completing a transaction and may refuse sales that do not meet legal requirements.

3.2 Age Verification Process

  • Customers must be 21 or older to access or purchase from the Site.
  •  In-person purchases may require a valid government-issued photo ID.
  • Online orders may require identity verification through an approved third-party service.
  • Orders that cannot be verified or appear fraudulent may be canceled.
  • Attempts by individuals under 21 to purchase products are strictly prohibited.

3.3 Right to Refuse Service

We may refuse or cancel an order if a customer:

  • Fails to provide acceptable proof of age
  • Submits altered, expired, or fraudulent identification
  • Appears to be purchasing on behalf of a minor
  • Declines or obstructs verification procedures

3.4 Privacy and Security

All verification checks comply with CCPA, GDPR, and other applicable privacy laws. Sensitive identification data is not stored, sold, or shared beyond what is required for legal compliance.

3.5 Policy Updates

We may update this policy to comply with legal or operational changes. Updates will be posted on the Site. Continued use of the Site after updates constitutes acceptance.

 

4) Use of the Site

License. We grant you a limited, non-exclusive, non-transferable license to use the Site and Services for personal use (and internal business use where expressly allowed) subject to these Terms.

Restrictions. You agree not to:

  • sell, license, or commercially exploit the Site or Services;
  • reverse engineer or create derivative works;
  • copy, distribute, or publicly display Site content except as allowed here;
  • use the Site to violate any law, infringe rights, or harm others;
  • scrape, mine, or collect data from the Site without permission;
  • bypass access or geographic restrictions.

Ownership. The Site, Services, software, and content are owned by Feral Cat or our licensors. No rights are granted except as stated in these Terms.

Trademarks. Bloom & BarrelSilver HawkPaso Red, and related names and logos are trademarks or service marks of Feral Cat. Other names and logos are the property of their owners. No rights are granted to use our marks without written permission. All goodwill from permitted use accrues to us.

Your content. If you submit, upload, post, or email content (“User Content”), you represent you have the rights to do so. You grant us a worldwide, royalty-free, transferable, sublicensable, perpetual license to host, store, display, modify, and use your User Content in connection with the Site, Services, and their promotion. We may create and use de-identified or aggregated usage data per our Privacy Policy.

We may preserve and disclose User Content if required by law or to protect rights, safety, or enforce these Terms.

User disputes. You are solely responsible for interactions with other users and third parties. We may, but are not required to, get involved.

4) Communications and Feedback

We may send you emails about our products and services. You can opt out of marketing emails using the unsubscribe link, but we may still send transactional or legal notices.

If you provide feedback or suggestions, you agree we can use them without restriction or compensation.

5) Acceptable Use

You agree not to use the Site to:

  • infringe intellectual property or privacy rights;
  • upload malware or harmful code;
  • harass, threaten, or post unlawful, defamatory, obscene, or hateful content;
  • send spam or unsolicited promotions;
  • impersonate others or attempt unauthorized access;
  • violate any law or encourage illegal activity;
  • bypass geographic or content protections (including via VPN).

We may monitor, suspend, or terminate access for violations and may report unlawful conduct to authorities.

Competitors. Individuals working for or on behalf of direct competitors may not access the Site without our written permission.

6) Purchases, Payments, Subscriptions, and Refunds

Availability. Products are offered DTC and through selected retail partners in eligible states. We may limit quantities or refuse orders. Title and risk of loss pass upon delivery to the carrier.

Payment processing. Payments are processed by third-party payment processors. Your use of payment features is subject to their terms and privacy policies. We are not responsible for payment processing services.

Taxes. You are responsible for applicable taxes and fees.

Subscriptions and account management. If you purchase a subscription, you authorize recurring charges to your selected payment method until you cancel. You can manage or cancel in your Site account. Please allow processing time before the next renewal.

Refund & Return Policy

  • Damaged or defective products. If your order arrives damaged, defective, or incorrect, please contact us at support@bloomandbarrelwine.com within 7 days of delivery. We’ll replace the item(s) at no additional cost or issue a full refund. To process your claim quickly, please provide your order number, a description of the issue, and photos of the product and packaging.
  • Returns. Because our beverages are perishable, we are unable to accept returns once they have left our facility. However, if there is an issue with your order, we will make it right through replacement, refund, or store credit.
  • Order cancellations. Orders may be canceled within 12 hours of purchase if they have not yet shipped. Once an order has been processed for shipment, it cannot be canceled.
  • Refunds. Approved refunds will be issued to your original method of payment within 5–7 business days. You will receive a confirmation email once your refund is processed.

7) Third-Party Links, Materials, and Deals

The Site may link to third-party websites, content, products, or services. We do not control or endorse third parties and are not responsible for their content, accuracy, policies, or practices. Your dealings with third parties are solely between you and them. Use appropriate caution.

Release. To the fullest extent permitted by law, you release us from claims arising out of third-party sites, materials, or interactions.

If you are a California resident, you waive California Civil Code § 1542 as described in the release above. Residents of other jurisdictions waive any comparable statute or doctrine to the extent permitted by law.

8) Disclaimers

Your use of the Site and Services is at your sole risk. The Site and Services are provided “as is” and “as available.” To the fullest extent permitted by law, we and our suppliers disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not guarantee the Site or Services will be uninterrupted, timely, secure, error-free, or free of viruses or harmful code.

Some jurisdictions do not allow certain disclaimers. In those places, the disclaimers apply to the maximum extent allowed by law.

9) Limitation of Liability

To the fullest extent permitted by law, we and our suppliers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or other intangible losses, arising out of or relating to the Site, Services, or these Terms, even if advised of the possibility.

Our total liability for any claim arising out of or relating to the Site, Services, or these Terms will not exceed fifty US dollars (US $50).

Some jurisdictions do not allow limitations of liability for certain damages. In those places, the limitations apply to the maximum extent allowed by law.

Your sole remedy if you are dissatisfied with any part of the Site or Services is to stop using them.

10) Term and Termination

These Terms remain in effect while you use the Site or Services. We may suspend or terminate access, or terminate these Terms, at any time for any reason, including policy violations. Upon termination, your right to use the Site and Services ends immediately. Sections that by their nature should survive (including Sections 1, 6, 7, 8, 9, 10, 11, and 12) will survive.

11) Copyright Policy (DMCA)

We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a notice including the information required by 17 U.S.C. § 512 to our Copyright Agent:

Your notice must include:

  • a physical or electronic signature of the rights owner or authorized agent;
  • identification of the copyrighted work(s) claimed infringed;
  • identification of the material claimed infringing and information reasonably sufficient to locate it;
  • your contact information;
  • a statement of good-faith belief the use is not authorized; and
  • a statement that the information is accurate and, under penalty of perjury, that you are the owner or authorized to act.

Counter-notice. If your content was removed in error, send a counter-notice with:

  • your signature;
  • identification of the removed material and where it appeared;
  • a statement under penalty of perjury the removal was a mistake or misidentification;
  • your contact information and consent to the jurisdiction of the federal court in the Central District of California and acceptance of service from the complainant.

We may restore content 10–14 business days after receiving a valid counter-notice unless the complainant files an action seeking a court order.

We may terminate accounts of repeat infringers.

12) Arbitration Agreement, Class Action Waiver, and Jury Trial Waiver

Arbitration. You and Feral Cat agree that any dispute or claim arising out of or relating to these Terms, the Site, the Services, advertising, or our relationship will be resolved by final and binding arbitration on an individual basis, except you may bring qualifying claims in small claims court.

Rules and forum. The Federal Arbitration Act governs this agreement. Arbitration will be administered by JAMSunder its Streamlined Arbitration Rules for claims under $250,000 and Comprehensive Rules for larger claims. You may choose telephone, video, written submissions, or in-person proceedings in your county of residence or another mutually agreed location. If JAMS is unavailable, the parties will select another administrator.

Arbitrator’s authority. The arbitrator has exclusive authority to resolve arbitrability issues and may award any individual relief available in court.

No jury; no class actions. You and Feral Cat waive the right to a jury trial. Claims must be brought individually, not as a class, collective, or representative action, and the arbitrator may not consolidate claims of multiple persons. Public injunctive relief may be awarded only to the extent required for enforceability.

Pre-arbitration resolution. Most concerns can be resolved quickly. Email us at Support@bloomandbarrel.com first. If unresolved, the party seeking arbitration must send a Notice of Dispute by certified mail to the address in Section 13.6 describing the claim and requested relief. If not resolved within 60 days, either party may begin arbitration.

Confidentiality. The arbitration proceeding and award are confidential.

Severability. If the class action waiver is found unenforceable, this arbitration section is void (unless required otherwise for public injunctive relief). The rest of the Terms remain in effect.

Future changes. If we change this arbitration section later, you may reject the change within 30 days by written notice to our address below, and the prior version will apply.

13) General

No support obligation. We may provide support at our discretion.

Changes to these Terms. We may update these Terms by posting a new version on the Site and/or providing notice through reasonable means. Changes are effective upon posting or notice. Continued use means you accept the changes.

Copyright/trademark notice. We reserve all rights in our trademarks. Third-party marks appearing on the Site are the property of their owners and used with permission or for identification.

Governing law; venue. These Terms are governed by the laws of the State of California, without regard to conflict of laws. For disputes not subject to arbitration, you and Feral Cat consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

Miscellaneous. These Terms are the entire agreement between you and us regarding the Site and Services. Our failure to enforce any provision is not a waiver. If any provision is found invalid, the rest remain in effect and the provision will be modified to the extent necessary to be enforceable. You may not assign these Terms without our written consent. We may assign them without restriction. Any claim must be brought within one year after it arose. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor conditions, internet or utility failures, or acts of government.
