Short answer: yes, in most of the country, with conditions attached.

Delta 9 wine made with hemp-derived THC is legal at the federal level under the 2018 Farm Bill. Whether you can buy it, and whether we can ship it to you, comes down to the state you live in.

That's the two-sentence version. The longer version is worth five minutes if you're about to order a bottle, because "delta 9" and "legal" both mean more than one thing depending on who's saying them.

What "delta 9 wine" actually means

Delta-9 THC is the compound in cannabis that produces the relaxed, lifted feeling people associate with it. It's the same molecule whether it comes from a marijuana plant or a hemp plant. If you want the chemistry, we wrote a plain guide to hemp-derived THC that covers it.

Delta 9 wine is wine infused with delta-9 THC. You'll see the same kind of product called THC wine, hemp infused wine, cannabis wine, or weed wine. Those names describe the same idea. The legal difference isn't the name. It's where the THC came from: hemp or marijuana.

The federal side: the 2018 Farm Bill

In 2018, Congress passed the Agriculture Improvement Act, usually called the 2018 Farm Bill. It defined hemp as cannabis containing no more than 0.3% delta-9 THC by dry weight and removed hemp from the Controlled Substances Act. Products made from hemp that stay under that line are federally legal.

Here's how that math works for a bottle of wine. A 750ml bottle weighs roughly 750 grams. Three tenths of one percent of that is 2,250mg. A bottle of Bloom & Barrel contains 20mg of THC total. That's less than one percent of the federal threshold, which is why a beverage can deliver a noticeable, social dose and still qualify as hemp under federal law.

Marijuana-derived wine is a different story. Cannabis-infused wines sold through licensed dispensaries are regulated as cannabis products. They can't cross state lines and you can't buy them online. If you're ordering delta 9 wine from a brand's website, it should be hemp-derived. If the site doesn't say so, close the tab.

The state side: where it gets complicated

The Farm Bill set the federal floor. States set their own rules on top of it, and most of them have.

Some states regulate hemp-derived THC beverages the way they regulate beer, with licensing, lab testing, labeling, and age limits. Some cap the milligrams per serving or per container. Some limit which retailers can sell them. And some have banned intoxicating hemp products outright.

The map changes several times a year. States that allowed shipping in 2024 closed in 2025. Others opened. That's why this post doesn't list states: any list would be wrong within months. What to check before you buy any delta 9 wine

Legal doesn't automatically mean trustworthy. The category grew fast and quality is uneven. Before you order from anyone, including us, look for:

• A Certificate of Analysis from an independent lab, for every batch. It should show the THC per serving and screen for contaminants. Ours are posted on our lab results page. If a brand won't show you a COA, that's your answer.
• A milligram number per serving on the label. Not "full spectrum hemp extract." A number.
• The words "hemp-derived" on the product page. If they aren't there, ask why.
• An age gate and a shipping policy that names states. A brand that ships everywhere is either ignoring the law or hoping you won't notice.
• Real wine, if that's what you want. Some delta 9 wine is grape-flavored water with THC in it. Ours won three awards in 2026 from judges who evaluated it as wine.

What's changing at the federal level

In November 2025, Congress passed legislation that changes the federal definition of hemp from the 0.3% dry-weight standard to a per-container THC limit. It was scheduled to take effect on November 12, 2026. A funding bill signed on September 2, 2026 pushed most of it to December 11, 2026. Industry groups, including the U.S. Hemp Roundtable, are working with lawmakers on a longer-term fix before that date, and separate bills would set per-serving limits with beverage-style regulation instead.

We don't know how it resolves yet. What we can tell you is that everything we sell today is legal under current federal law and the laws of every state we ship to, every batch is lab-tested, and we'll update this post as the picture changes. Check the date at the top.

Legal to buy, and legal to drink?

Both, in states where it's sold. But legal doesn't make it a good idea in every situation.
